St Maarten is one island with two legal systems, and where you buy decides which one applies. The areas below group into the busy west, the quiet east and the French side.
On the Dutch side, Simpson Bay and Pelican Key are the convenience and rental heartland, close to marinas, restaurants, nightlife and shops. Agencies describe Simpson Bay and Maho as the highest-occupancy vacation rental zones on the island, which is consistent with the rental data in the market article earlier in this series, though the claim comes from agency guides. Maho adds the airport beach, casinos and heavy tourist turnover, so it suits investors more than anyone wanting quiet. Condos and waterfront residences dominate.
Cupecoy is the modern end of the market, with newer condo buildings, Mullet Bay Beach nearby, and proximity to the American University of the Caribbean and Porto Cupecoy marina, which supports steady demand from students and seasonal residents. Brokers say Simpson Bay, Beacon Hill and Cupecoy have the largest number of condo listings on the Dutch side. For a quieter setting, the eastern side offers ocean views and separation from the busiest districts. Oyster Pond sits on the Dutch-French border around a lagoon and suits boaters, and Dawn Beach and Guana Bay have villas and ocean-view apartments. One brokerage puts solid three or four-bedroom villas in Guana Bay or Oyster Pond from about US$1 million to US$2 million.
On the French side, Terres Basses is the prestige address, with large gated parcels and villas. The same brokerage says villas there generally start at US$2 million, and the finest beachfront estates reach US$5 million and above. Orient Bay is a beach community with steady visitor demand, and Grand Case suits buyers who want a quieter base near some of the island's best-known waterfront restaurants.
A Dutch-side purchase runs through a civil law notary and carries a 4% buyer transfer tax, covered in our legal and tax guide to St Maarten. A French-side purchase follows French law, with its own notary process, and its costs were not researched for this article, so get them from a French-side notary before comparing the two.
