1. Can Foreigners Buy Property? The Legal Framework
No Ownership Restrictions
There are no restrictions on foreign nationals — of any nationality — purchasing property in St Barts. EU citizens purchase on exactly the same terms as French nationals, with no additional procedures. Non-EU buyers (British post-Brexit, Americans, Canadians, Swiss, and all others) purchase on the same open terms — French law does not impose foreign ownership restrictions on real estate in France or its overseas territories, and the Collectivite de Saint-Barthelemy has imposed no additional restrictions of its own. The purchase process is the same for all buyers regardless of nationality: through the French notarial system, subject to French property law as applied in St Barts.
The Notaire — The Central Professional
Every property transfer in St Barts must be authenticated by a notaire. The notaire's role in St Barts is identical to that in Guadeloupe and Martinique — a state-appointed public official responsible for the legal correctness of the transaction, the verification of title, the collection and remittance of droits de mutation, and the registration of the transfer. There are very few notaires on St Barts (the island's size and transaction volume support only a small notarial practice), and the island's notaires are experienced in transactions with international buyers given the market's international character.
For the most complex transactions — very high-value properties, corporate or trust acquisition structures, or transactions with complex cross-border legal and tax implications — buyers frequently engage French property lawyers (avocats specialising in French property and international transactions) in addition to the island's notaires. At these price points, the cost of comprehensive professional advice is not a material factor relative to the transaction value, and the benefit of having specialist legal oversight across all aspects of the acquisition is significant.
